Coordinatori direttive
Al fine di promuovere un’applicazione uniforme della direttiva, l’art. 6, comma 1, del d.lgs. 206/2007, attribuisce al Dipartimento Politiche Comunitarie, i compiti di Coordinatore nazionale e di Punto nazionale di contatto, previsti dagli articoli 56 e 57 della direttiva 2005/36/CE.
Il coordinatore promuove l’applicazione uniforme della direttiva da parte delle autorità competenti e la circolazione di ogni informazione utile per la sua applicazione, in particolare quelle relative alle condizioni di accesso alle professioni regolamentate negli Stati membri (l’articolo 6 del decreto legislativo di recepimento ha ripreso tali disposizioni e ha confermato i compiti di Coordinatore nazionale presso il Dipartimento per il coordinamento delle politiche comunitarie).
Il coordinatore nazionale, sulla base dell’art. 6, comma 2, promuove:
- una applicazione uniforme del presente decreto da parte delle autorità di cui all'articolo 5;
- la circolazione di ogni informazione utile ad assicurare l'applicazione del presente decreto, in particolare quelle relative alle condizioni d'accesso alle professioni regolamentate.
Per meglio facilitare l’applicazione uniforme di tutte le disposizione previste dalla direttiva, ed evitare, altresì, un’attuazione erronea della stessa, l’Unione Europea ha adottato la Decisione della Commissione del 19 marzo 2007, con la quale è stato istituito uno specifico gruppo composto dai Coordinatori nazionali designati dagli Stati membri. Tale gruppo ha in particolar modo il compito di garantire il coordinamento tra tutte le amministrazioni competenti al riconoscimento delle qualifiche nazionali.
In particolare i compiti del Gruppo di Coordinatori, identificati dall’articolo 2 della citata Decisione, sono i seguenti:
- creare una cooperazione tra le autorità degli Stati membri e la Commissione su aspetti relativi al riconoscimento delle qualifiche professionali. Questo compito, a parere della Commissione, può andare oltre gli aspetti relativi alla direttiva “qualifiche”, ad esempio potrebbe ricomprendere questioni legate all’applicazione del Trattato, o l’esame delle proposte di accordo sul riconoscimento reciproco che la Commissione ha avuto mandato di elaborare nei confronti dei Paesi terzi (in particolare è allo studio un accordo con gli USA);
- monitorare l’evoluzione delle politiche che hanno un impatto sulle professioni regolamentate per quel che riguarda le qualifiche; ad es. le politiche per l’istruzione, che possono avere un impatto sulle professioni settoriali;
- facilitare l’applicazione della Direttiva 2005/36/CE, in particolare mediante l’elaborazione di documenti di interesse comune, quali il codice di condotta già adottato in passato. Questo compito dà una valenza particolare al ruolo dei Coordinatori, permettendo anche di mettere in evidenza le buone pratiche.
